Public Urged to Use Encryption for Mobile Phone Messaging and Calls

On December 4, 2024, four of the five members of the Five Eyes intelligence-sharing group (the United States, Australia, Canada, and New Zealand) law enforcement and cyber security agencies (Agencies) published a joint guide for network engineers, defenders of communications infrastructure and organizations with on-premises enterprise equipment (the Guide). The Agencies strongly encourage applying the Guide’s best practices to strengthen visibility and strengthen network devices against exploitation by reported hackers, including those hackers affiliated with the People’s Republic of China (PRC). The fifth group member, the United Kingdom, released a statement supportive of the joint guide but stated it had alternate methods of mitigating cyber risks for its telecom providers.

In November 2024, the Federal Bureau of Investigation (FBI) and the U.S. Cybersecurity and Infrastructure Security Agency (CISA) issued a joint statement to update the public on its investigation into the previously reported PRC-affiliated hacks on multiple telecommunications companies’ networks. The FBI and CISA reported that these hacks appeared to focus on cell phone activity of individuals involved in political or government activity and copies of law enforcement informational requests subject to court orders. However, at the time of the update, these U.S. agencies and members of Congress have underscored the broad and significant nature of this breach. At least one elected official stated that the hacks potentially expose unencrypted cell phone conversations with someone in America to the hackers.

In particular, the Guide recommends adopting actions that quickly identify anomalous behavior, vulnerabilities, and threats and respond to a cyber incident. It also guides telecoms and businesses to reduce existing vulnerabilities, improve secure configuration habits, and limit potential entry points. One of the Guide’s recommended best practices attracting media attention is ensuring that mobile phone messaging and call traffic is fully end-to-end encrypted to the maximum extent possible. Without fully end-to-end encrypted messaging and calls, the content of calls and messages always has the potential to be intercepted. Android to Android messaging and iPhone to iPhone messaging is fully end-to-end encrypted but messaging from an Android to an iPhone is not currently end-to-end encrypted. Google and Apple recommend using a fully encrypted messaging app to better protect the content of messages from hackers.

The FBI and CISA are continuing to investigate the hacks and will update the public as the investigation permits. In the interim, telecom providers and companies are encouraged to adopt the Guide’s best practices and to report any suspicious activity to their local FBI field office or the FBI’s Internet Crime Complaint Center. Cyber incidents may also be reported to CISA.

HIPAA Gets a Potential Counterpart in HISAA

Americans hear about cybersecurity incidents on a frequent basis. As the adage goes, it is not a matter of “if” a breach or security hack occurs; it is a matter of “when.” At no time was that more evident earlier this year when the healthcare industry was hit with the widespread ransomware attack on Change Healthcare, a subsidiary of the United Health Group. Because of the nature of the Change Healthcare shutdown and its impact across the industry, the U.S. Department of Health & Human Services (HHS) and its HIPAA enforcement arm, the Office for Civil Rights (OCR), conducted investigations and issued FAQ responses for those impacted by the cybersecurity event.

In further response, Senators Ron Wyden (D-OR) and Mark Warner (R-VA) introduced the Health Infrastructure Security and Accountability Act (HISAA) on September 26, 2024. Like HIPAA and HITECH before it, which established minimum levels of protection for healthcare information, HISAA looks to reshape how healthcare organizations address cybersecurity by enacting mandatory minimum security standards to protect healthcare information and by providing initial financial support to facilitate compliance. To date, HIPAA and HITECH require covered entities and business associates to develop, implement, and maintain reasonable and appropriate “administrative, technical, physical” safeguards to protect electronic Protected Health Information or e-PHI. However, the safeguards do not specify minimum requirements; instead, they prescribe standards intended to be scalable, depending on the specific needs, resources, and capabilities of the respective organization. What this means is that e-PHI stored or exchanged among interconnected networks are subject to systems with often different levels of sophistication or protection.

Given the considerable time, effort, and resources dedicated to HIPAA/HITECH compliance, many consider the current state of voluntary safeguards as inadequate. This is especially the case since regulations under the HIPAA Security Rule have not been updated since 2013. As a result, Senators Wyden and Warner introduced HISAA in an effort to bring the patchwork of healthcare data security standards under one minimum umbrella and to require healthcare organizations to remain on top of software systems and cybersecurity standards.

Key pieces of HISAA, as proposed, include:

  1. Mandatory Cybersecurity Standards—If enacted, the Secretary of HHS, together with the Director of the Cybersecurity and Infrastructure Security Agency (CISA) and the Director of National Intelligence (DNI), will oversee the development and implementation of required standards and the standards will be subject to review and update every two years to counter evolving threats.
  2. Annual Audits and Stress Tests—Like current Security Risk Assessment (SRA) requirements, HISAA will require healthcare organizations to conduct annual cybersecurity audits and document the results. Unlike current requirements, these audits will need to be conducted by independent organizations to assess compliance, evaluate restoration abilities, and conduct stress tests in real-world simulations. While smaller organizations may be eligible for waivers from certain requirements because of undue burden, all healthcare organizations will have to publicly disclose compliance status as determined by these audits.
  3. Increased Accountability and Penalties—HISAA would implement significant penalties for non-compliance and would require healthcare executives to certify compliance on an annual basis. False information in such certifications could result in criminal charges, including fines of up to $1 million and prison time for up to 10 years. HISAA would also eliminate fine caps to allow HHS to impose penalties commiserate with the level needed to deter lax behaviors, especially among larger healthcare organizations.
  4. Financial Support for Enhancements—Because the costs for new standards could be substantial, especially for smaller organizations, HISAA would allocate $1.3 billion to support hospitals for infrastructure enhancements. Of this $1.3 billion, $800 million would be for rural and safety net hospitals over the first two years, and an additional $500 million would be available for all hospitals in succeeding years.
  5. Medicare Payment Adjustments—Finally, HISAA enables the Secretary of HHS to provide accelerated Medicare payments to organizations impacted by cybersecurity events. HHS offered similar accelerated payments during the Change Healthcare event, and HISAA would codify similar authority to HHS for recovery periods related to future cyberattacks.

While HISAA will establish a baseline of cybersecurity requirements, compliance with those requirements will require a significant investment of time and resources in devices and operating systems/software, training, and personnel. Even with the proposed funding, this could result in substantial challenges for smaller and rural facilities to comply. Moreover, healthcare providers will need to prioritize items such as encryption, multi-factor authentication, real-time monitoring, comprehensive response and remediation plans, and robust training and exercises to support compliance efforts.

Finally, at this juncture, the more important issue is for healthcare organizations to recognize their responsibilities in maintaining effective cybersecurity practices and to stay updated on any potential changes to these requirements. Since HISAA was introduced in the latter days of a hectic (and historic) election season, we will monitor its progress as the current Congress winds down in 2024 and the new Congress readies for action with a new administration in 2025.

Mandatory Cybersecurity Incident Reporting: The Dawn of a New Era for Businesses

A significant shift in cybersecurity compliance is on the horizon, and businesses need to prepare. Starting in 2024, organizations will face new requirements to report cybersecurity incidents and ransomware payments to the federal government. This change stems from the U.S. Department of Homeland Security’s (DHS) Cybersecurity Infrastructure and Security Agency (CISA) issuing a Notice of Proposed Rulemaking (NPRM) on April 4, 2024. This notice aims to enforce the Cyber Incident Reporting for Critical Infrastructure Act of 2022 (CIRCIA). Essentially, this means that “covered entities” must report specific cyber incidents and ransom payments to CISA within defined timeframes.

Background

Back in March 2022, President Joe Biden signed CIRCIA into law. This was a big step towards improving America’s cybersecurity. The law requires CISA to create and enforce regulations mandating that covered entities report cyber incidents and ransom payments. The goal is to help CISA quickly assist victims, analyze trends across different sectors, and share crucial information with network defenders to prevent other potential attacks.

The proposed rule is open for public comments until July 3, 2024. After this period, CISA has 18 months to finalize the rule, with an expected implementation date around October 4, 2025. The rule should be effective in early 2026. This document provides an overview of the NPRM, highlighting its key points from the detailed Federal Register notice.

Cyber Incident Reporting Initiatives

CIRCIA includes several key requirements for mandatory cyber incident reporting:

  • Cyber Incident Reporting Requirements – CIRCIA mandates that CISA develop regulations requiring covered entities to report any covered cyber incidents within 72 hours from the time the entity reasonably believes the incident occurred.
  • Federal Incident Report Sharing – Any federal entity receiving a report on a cyber incident after the final rule’s effective date must share that report with CISA within 24 hours. CISA will also need to make information received under CIRCIA available to certain federal agencies within the same timeframe.
  • Cyber Incident Reporting Council – The Department of Homeland Security (DHS) must establish and chair an intergovernmental Cyber Incident Reporting Council to coordinate, deconflict, and harmonize federal incident reporting requirements.

Ransomware Initiatives

CIRCIA also authorizes or mandates several initiatives to combat ransomware:

  • Ransom Payment Reporting Requirements – CISA must develop regulations requiring covered entities to report to CISA within 24 hours of making any ransom payments due to a ransomware attack. These reports must be shared with federal agencies similarly to cyber incident reports.
  • Ransomware Vulnerability Warning Pilot Program – CISA must establish a pilot program to identify systems vulnerable to ransomware attacks and may notify the owners of these systems.
  • Joint Ransomware Task Force – CISA has announced the launch of the Joint Ransomware Task Force to build on existing efforts to coordinate a nationwide campaign against ransomware attacks. This task force will work closely with the Federal Bureau of Investigation and the Office of the National Cyber Director.

Scope of Applicability

The regulation targets many “covered entities” within critical infrastructure sectors. CISA clarifies that “covered entities” encompass more than just owners and operators of critical infrastructure systems and assets. Entities actively participating in these sectors might be considered “in the sector,” even if they are not critical infrastructure themselves. Entities uncertain about their status are encouraged to contact CISA.

Critical Infrastructure Sectors

CISA’s interpretation includes entities within one of the 16 sectors defined by Presidential Policy Directive 21 (PPD 21). These sectors include Chemical, Commercial Facilities, Communications, Critical Manufacturing, Dams, Defense Industrial Base, Emergency Services, Energy, Financial Services, Food and Agriculture, Government Facilities, Healthcare and Public Health, Information Technology, Nuclear Reactors, Materials, and Waste, Transportation Systems, Water and Wastewater Systems.

Covered Entities

CISA aims to include small businesses that own and operate critical infrastructure by setting additional sector-based criteria. The proposed rule applies to organizations falling into one of two categories:

  1. Entities operating within critical infrastructure sectors, except small businesses
  2. Entities in critical infrastructure sectors that meet sector-based criteria, even if they are small businesses

Size-Based Criteria

The size-based criteria use Small Business Administration (SBA) standards, which vary by industry and are based on annual revenue and number of employees. Entities in critical infrastructure sectors exceeding these thresholds are “covered entities.” The SBA standards are updated periodically, so organizations must stay informed about the current thresholds applicable to their industry.

Sector-Based Criteria

The sector-based criteria target essential entities within a sector, regardless of size, based on the potential consequences of disruption. The proposed rule outlines specific criteria for nearly all 16 critical infrastructure sectors. For instance, in the information technology sector, the criteria include:

  • Entities providing IT services for the federal government
  • Entities developing, licensing, or maintaining critical software
  • Manufacturers, vendors, or integrators of operational technology hardware or software
  • Entities involved in election-related information and communications technology

In the healthcare and public health sector, the criteria include:

  • Hospitals with 100 or more beds
  • Critical access hospitals
  • Manufacturers of certain drugs or medical devices

Covered Cyber Incidents

Covered entities must report “covered cyber incidents,” which include significant loss of confidentiality, integrity, or availability of an information system, serious impacts on operational system safety and resiliency, disruption of business or industrial operations, and unauthorized access due to third-party service provider compromises or supply chain breaches.

Significant Incidents

This definition covers substantial cyber incidents regardless of their cause, such as third-party compromises, denial-of-service attacks, and vulnerabilities in open-source code. However, threats or activities responding to owner/operator requests are not included. Substantial incidents include encryption of core systems, exploitation causing extended downtime, and ransomware attacks on industrial control systems.

Reporting Requirements

Covered entities must report cyber incidents to CISA within 72 hours of reasonably believing an incident has occurred. Reports must be submitted via a web-based “CIRCIA Incident Reporting Form” on CISA’s website and include extensive details about the incident and ransom payments.

Report Types and Timelines

  • Covered Cyber Incident Reports within 72 hours of identifying an incident
  • Ransom Payment Reports due to a ransomware attack within 24 hours of payment
  • Joint Covered Cyber Incident and Ransom Payment Reports within 72 hours for ransom payment incidents
  • Supplemental Reports within 24 hours if new information or additional payments arise

Entities must retain data used for reports for at least two years. They can authorize a third party to submit reports on their behalf but remain responsible for compliance.

Exemptions for Similar Reporting

Covered entities may be exempt from CIRCIA reporting if they have already reported to another federal agency, provided an agreement exists between CISA and that agency. This agreement must ensure the reporting requirements are substantially similar, and the agency must share information with CISA. Federal agencies that report to CISA under the Federal Information Security Modernization Act (FISMA) are exempt from CIRCIA reporting.

These agreements are still being developed. Entities reporting to other federal agencies should stay informed about their progress to understand how they will impact their reporting obligations under CIRCIA.

Enforcement and Penalties

The CISA director can make a request for information (RFI) if an entity fails to submit a required report. Non-compliance can lead to civil action or court orders, including penalties such as disbarment and restrictions on future government contracts. False statements in reports may result in criminal penalties.

Information Protection

CIRCIA protects reports and RFI responses, including immunity from enforcement actions based solely on report submissions and protections against legal discovery and use in proceedings. Reports are exempt from Freedom of Information Act (FOIA) disclosures, and entities can designate reports as “commercial, financial, and proprietary information.” Information can be shared with federal agencies for cybersecurity purposes or specific threats.

Business Takeaways

Although the rule will not be effective until late 2025, companies should begin preparing now. Entities should review the proposed rule to determine if they qualify as covered entities and understand the reporting requirements, then adjust their security programs and incident response plans accordingly. Creating a regulatory notification chart can help track various incident reporting obligations. Proactive measures and potential formal comments on the proposed rule can aid in compliance once the rules are finalized.

These steps are designed to guide companies in preparing for CIRCIA, though each company must assess its own needs and procedures within its specific operational, business, and regulatory context.

How a Zero-Day Flaw in MOVEit Led to a Global Ransomware Attack

In an era where our lives are ever more intertwined with technology, the security of digital platforms is a matter of national concern. A recent large-scale cyberattack affecting several U.S. federal agencies and numerous other commercial organizations emphasizes the criticality of robust cybersecurity measures.

The Intrusion

On June 7, 2023, the Cybersecurity and Infrastructure Security Agency (CISA) identified an exploit by “Threat Actor 505” (TA505), namely, a previously unidentified (zero-day) vulnerability in a data transfer software called MOVEit. MOVEit is a file transfer software used by a broad range of companies to securely transfer files between organizations. Darin Bielby, the managing director at Cypfer, explained that the number of affected companies could be in the thousands: “The Cl0p ransomware group has become adept at compromising file transfer tools. The latest being MOVEit on the heels of past incidents at GoAnywhere. Upwards of 3000 companies could be affected. Cypfer has already been engaged by many companies to assist with threat actor negotiations and recovery.”

CISA, along with the FBI, advised that “[d]ue to the speed and ease TA505 has exploited this vulnerability, and based on their past campaigns, FBI and CISA expect to see widespread exploitation of unpatched software services in both private and public networks.”

Although CISA did not comment on the perpetrator behind the attack, there are suspicions about a Russian-speaking ransomware group known as Cl0p. Much like in the SolarWinds case, they ingeniously exploited vulnerabilities in widely utilized software, managing to infiltrate an array of networks.

Wider Implications

The Department of Energy was among the many federal agencies compromised, with records from two of its entities being affected. A spokesperson for the department confirmed they “took immediate steps” to alleviate the impact and notified Congress, law enforcement, CISA, and the affected entities.

This attack has ramifications beyond federal agencies. Johns Hopkins University’s health system reported a possible breach of sensitive personal and financial information, including health billing records. Georgia’s statewide university system is investigating the scope and severity of the hack affecting them.

Internationally, the likes of BBC, British Airways, and Shell have also been victims of this hacking campaign. This highlights the global nature of cyber threats and the necessity of international collaboration in cybersecurity.

The group claimed credit for some of the hacks in a hacking campaign that began two weeks ago. Interestingly, Cl0p took an unusual step, stating that they erased the data from government entities and have “no interest in exposing such information.” Instead, their primary focus remains extorting victims for financial gains.

Still, although every file transfer service based on MOVEit could have been affected, that does not mean that every file transfer service based on MOVEit was affected. Threat actors exploiting the vulnerability would likely have had to independently target each file transfer service that employs the MOVEit platform. Thus, companies should determine whether their secure file transfer services rely on the MOVEit platform and whether any indicators exist that a threat actor exploited the vulnerability.

A Flaw Too Many

The attackers exploited a zero-day vulnerability that likely exposed the data that companies uploaded to MOVEit servers for seemingly secure transfers. This highlights how a single software vulnerability can have far-reaching consequences if manipulated by adept criminals. Progress, the U.S. firm that owns MOVEit, has urged users to update their software and issued security advice.

Notification Requirements

This exploitation likely creates notification requirements for the myriad affected companies under the various state data breach notification laws and some industry-specific regulations. Companies that own consumer data and share that data with service providers are not absolved of notification requirements merely because the breach occurred in the service provider’s environment. Organizations should engage counsel to determine whether their notification requirements are triggered.

A Call to Action

This cyberattack serves as a reminder of the sophistication and evolution of cyber threats. Organizations using the MOVEit software should analyze whether this vulnerability has affected any of their or their vendors’ operations.

With the increasing dependency on digital platforms, cybersecurity is no longer an option but a necessity in a world where the next cyberattack is not a matter of “if” but “when;” it’s time for a proactive approach to securing our digital realms. Organizations across sectors must prioritize cybersecurity. This involves staying updated with the latest security patches and ensuring adequate protective measures and response plans are in place.

Secure Software Regulations and Self-Attestation Required for Federal Contractors

US Policy and Regulatory Alert

Government contractors providing software across the federal government’s supply chain will be required later this year to comply with a new Secure Software Design Framework (SSDF). The SSDF requires software vendors to attest to new security controls in the design of code used by the federal government.

Cybersecurity Compromises of Government Software on the Rise

In the aftermath of the cybersecurity compromises of significant enterprise software systems embedded in government supply chains, the federal government has increasingly prioritized reducing the vulnerability of software used within agency networks. Recognizing that most of the enterprise software that is used by the federal government is provided by a wide range of private sector contractors, the White House has been moving to impose a range of new software security regulations on both prime and subcontractors. One priority area is an effort to require government contractors to ensure that software used by federal agencies incorporates security by design. As a result, federal contractors supplying software to the government now face a new set of requirements to supply secure software code. That is, to provide software that is developed with security in mind so that flaws and vulnerabilities can be mitigated before the government buys and deploys the software.

The SSDF as A Government Response

In response, the White House issued Executive Order 14028, “Executive Order on Improving the Nation’s Cybersecurity” (EO 14028), on 12 May 2021. EO 14028 requires the National Institute of Standards and Technology (NIST) to develop standards, tools, and best practices to enhance the security of the software supply chain. NIST subsequently promulgated the SSDF in special publication NIST SP 800-218. EO 14028 also mandates that the director of the Office of Management and Budget (OMB) take appropriate steps to ensure that federal agencies comply with NIST guidance and standards regarding the SSDF. This resulted in OMB Memorandum M-22-18, “Enhancing the Security of the Software Supply Chain through Secure Software Development Practices” (M-22-18). The OMB memo provides that a federal agency may use software subject to M-22-18’s requirements only if the producer of that software has first attested to compliance with federal government-specified secure software development practices drawn from the SSDF. Meaning, if the producer of the software cannot attest to meeting the NIST requirements, it will not be able to supply software to the federal government. There are some exceptions and processes for software to gradually enter into compliance under various milestones for improvements, all of which are highly technical and subjective.

In accordance with these regulations, the Cybersecurity and Infrastructure Security Agency (CISA) of the Department of Homeland Security issued a draft form for collecting the relevant attestations and associated information. CISA released the draft form on 27 April 2023 and is accepting comments until 26 June 2023.1

SSDF Implementation Deadline and Requirements for Government Suppliers

CISA initially set a deadline of 11 June 2023 for critical software and 13 September 2023 for non-critical software to comply with SSDF. Press reports indicate that these deadlines will be extended due to both the complexity of the SSDF requirements and the fact that the comment period remains open until 26 June  2023. However, CISA has not yet confirmed an extension of the deadline.

Attestation and Compliance with the SSDF

Based on what we know now, the attestation form generally requires software producers to confirm that:

  • The software was developed and built in secure environments.
  • The software producer has made a good-faith effort to maintain trusted source code supply chains.
  • The software producer maintains provenance data for internal and third-party code incorporated into the software.
  • The software producer employed automated tools or comparable processes that check for security vulnerabilities.

Software producers that must comply with SSDF should move quickly and begin reviewing their approach to software security. The SSDF requirements are complex and likely will take time to review, implement, and document. In particular, many of the requirements call for subjective analysis rather than objective evaluation against a set of quantifiable criteria, as is usually the case with such regulations. The SSDF also includes numerous ambiguities. For example, the SSDF requires versioning changes in software to have certain impacts in the security assessment, although the term “versioning” does not have a standard definition in the software sector.

Next Steps and Ricks of Noncompliance

Critically, the attestations on the new form carry risk under the civil False Claims Act for government contractors and subcontractors. Given the fact that many of the attestations require subjective analysis, contractors must take exceptional care in completing the attestation form. Contractors should carefully document their assessment that the software they produce is compliant. In particular, contractors and other interested parties should use this opportunity to share feedback and insights with CISA through the public comment process.

Cyber Incident Reporting for Critical Infrastructure Act

On September 12, 2022, the Cybersecurity and Infrastructure Security Agency (“CISA”) released a Request for Information (“RFI”) seeking public input regarding the Cyber Incident Reporting for Critical Infrastructure Act of 2022 (“CIRCIA”). The public comment period will close on November 14th, 2022. The RFI provides a “non-exhaustive” list of topics on which CISA seeks public input, including:

  • Definitions and criteria of various terms, such as “covered entity,” “covered cyber incident,” “substantial cyber incident,” “ransom payment,” “ransom attack,” “supply chain compromise” and “reasonable belief;”
  • Content of reports on covered cyber incidents and the submission process (e.g., how entities should submit reports, report timing requirements, and which federal entities should receive reports;
  • Any conflict with existing or proposed federal or state cyber incident reporting requirements;
  • The expected time and costs associated with reporting requirements; and
  • Common best practices governing the sharing of information related to security vulnerabilities in the U.S. and internationally.

In March 2022, President Biden signed CIRCIA into law. CIRCIA creates legal protections and provides guidance to companies that operate in critical infrastructure sectors, including a requirement to report cyber incidents within 72 hours, and report ransom payments within 24 hours. The CISA website features more information about the law, the RFI, and a list of public listening sessions with CISA to provide input.

Small Businesses Don’t Recognize Risk of Cyberattack Despite Repeated Warnings

CNBC surveys over 2,000 small businesses each quarter to get their thoughts on the overall business environment and their small business’ health. According to the latest CNBC/SurveyMonkey Small Business Survey, despite repeated warnings by the Cybersecurity and Infrastructure Security Agency and the FBI that U.S.- based businesses are at an increased risk of a cyber-attack following Russia’s invasion of Ukraine, small business owners do not believe that it is an actual risk that will affect them, and they are not prepared for an attack. The latest survey shows that only five percent of small business owners reported cybersecurity to be the biggest risk to their company.

What is unfortunate, but not surprising, is the fact that this is the same percentage of small business owners who recognized a cyber attack as the biggest risk a year ago. There has been no change in the perception among business owners, even though there are repeated, dire warnings from the government. Also unfortunate is the statistic that only 33 percent of business owners with one to four employees are concerned about a cyber attack this year. In contrast, 61 percent of business owners with more than 50 employees have the same concern.

According to CNBC, “this general lack of concern among small business owners diverges from the sentiment among the general public….In SurveyMonkey’s polling, 55% of people in the U.S. say they would be less likely to continue to do business with brands who are victims of a cyber attack.” CNBC’s conclusion is that there is a disconnect between business owners’ appreciation of how much customers care about data security and that “[s]mall businesses that fail to take the cyber threat seriously risk losing customers, or much more, if a real threat emerges.” Statistics show that threat actors are targeting small to medium-sized businesses to stay under the law enforcement radar. With such a large target on their backs, business owners may wish to make cybersecurity a priority. It’s important to keep customers.

Patch Up – Log4j and How to Avoid a Cybercrime Christmas

A vulnerability so dangerous that Cybersecurity and Infrastructure (CISA) Director Jen Easterly called it “one of the most serious [she’s] seen in [her] entire career, if not the most serious” arrived just in time for the holidays. On December 10, 2021, CISA and the director of cybersecurity at the National Security Agency (NSA) began alerting the public of a critical vulnerability within the Apache Log4j Java logging framework. Civilian government agencies have been instructed to mitigate against the vulnerability by Christmas Eve, and companies should follow suit.

The Log4j vulnerability allows threat actors to remotely execute code both on-premises and within cloud-based application servers, thereby obtaining control of the impacted servers. CISA expects the vulnerability to affect hundreds of millions of devices. This is a widespread critical vulnerability and companies should quickly assess whether, and to what extent, they or their service providers are using Log4j.

Immediate Recommendations

  • Immediately upgrade all versions of Apache Log4j to 2.15.0.
  • Ask your service providers whether their products or environment use Log4j, and if so, whether they have patched to the latest version. Helpfully, CISA sponsors a community-sourced GitHub repository with a list of software related to the vulnerability as a reference guide.
  • Confirm your security operations are monitoring internet-facing systems for indicators of compromise.
  • Review your incident response plan and ensure all response team information is up to date.
  • If your company is involved in an acquisition, discuss the security steps taken within the target company to address the Log4j vulnerability.

The versatility of this vulnerability has already attracted the attention of malicious nation-state actors. For example, government-affiliated cybercriminals in Iran and China have a “wish list” (no holiday pun intended) of entities that they are aggressively targeting with the Log4j vulnerability. Due to this malicious nation-state activity, if your company experiences a ransomware attack related to the Log4j vulnerability, it is particularly important to pay attention to potential sanctions-related issues.
